Discrimination Against Persons with Disabilities

In Nigeria, approximately 25 million people are living with a disability. Despite being a significant part of the population, many of these individuals experience discrimination and are not granted access to fundamental rights and services. However, there have been recent advancements in the promotion of disability rights in Nigeria.


In 2018, the Discrimination Against Persons with Disabilities (Prohibition) Act was signed into law by Nigeria’s President Muhammadu Buhari. This significant legislation came about as a result of 9 years of tireless advocacy by disability rights groups and activists. The act's purpose is to safeguard the rights of disabled individuals and encourage their inclusion in society.


The act forbids discrimination based on disability and imposes penalties, including fines and imprisonment, on those who violate its provisions. It also requires that public buildings and transportation be accessible and that special education be provided for children with disabilities. The law also establishes a five-year transition period for modifying public buildings, structures, and vehicles to make them accessible and usable for people with disabilities.


Furthermore, the act creates a National Commission for Persons with Disabilities, which is tasked with ensuring that people with disabilities have access to housing, education, and healthcare. The Commission has the authority to receive complaints of rights violations and assist victims in seeking legal redress.


Although the enactment of this act represents significant progress for disability rights in Nigeria, there is still much to be done. Many disabled individuals continue to encounter obstacles to education, employment, healthcare, and housing.
